ArmourGrid, Inc. and its affiliates (collectively, “ArmourGrid,” “we” or “us”) respect your personal privacy and are committed to adhering to federal, state and local privacy laws and industry guidelines in order to protect you and your identity.  ArmourGrid DOES NOT sell or provide your data to any third party vendors. This privacy policy (“Privacy Policy”) describes how how we collect, use, and disclose information about you that we collect through: (a) our mobile application called Safety Kuvrr; (b) www.armourgrid.com, www.kuvrr.com, safety.kuvrr.com and mobile websites; (c) microsites; (d) pages on social media sites; (e) HTML-formatted email messages that we send to you; and (f) any other digital services and properties operated or used by us from time to time (collectively, “Safety Kuvrr”). Information is used solely by ArmourGrid, our monitoring partners (“Organizations”) and emergency responders such as college campus security, municipalities, enterprises, Fire, Police, EMS etc (collectively, “Agencies”) as needed. Please be sure to read this entire Privacy Policy before using, submitting, or uploading information and any materials to Safety Kuvrr. 

If you are unwilling to accept the terms and conditions of this Privacy Policy, we ask that you do not use Safety Kuvrr.  By using Safety Kuvrr, you agree to the terms of this Privacy Policy.  When you submit information via Safety Kuvrr, you consent to the collection, use and disclosure of that information in accordance with this Privacy Policy. ArmourGrid reserves the right to occasionally update this Privacy Policy. At such time, ArmourGrid will also revise the “last updated” date at the end of the Privacy Policy. For material changes to this Privacy Policy, ArmourGrid will notify you by placing a prominent notice on the Service. We recommend that you periodically review this Privacy Policy.

1. PERSONAL INFORMATION THE COMPANY COLLECTS FROM YOU

A. Registration and Profile Information: As part of the registration process, you will be asked to provide information including, but not limited to, a phone number, an e-mail address, your name, one or more contact phone numbers and contact information for your designated recipients.  If you elect to purchase a premium service, our billing partners, Apple, Google and Stripe may collect billing and payment information from you.  From time-to-time, Safety Kuvrr may include functionality that permits you to provide profile information that may be accessible by recipients that you designate and applicable emergency responders.  This profile information may include, but is not limited to:  height, weight, personal photos, emergency contact information, allergies, medical conditions, disabilities, vehicle information, and other information that may be of assistance to people responding to incidents you report through Safety Kuvrr.  You may also have the ability to submit free text notes, which includes other information that does not specifically fall within categories offered by Safety Kuvrr account management tools.

When you use Safety Kuvrr, we will not collect any of the foregoing personally identifiable information about you unless you provide it to us voluntarily.  When you create your personal vault of information, you will be asked for both personal and demographic information, some of which is required in order to complete the registration.

B. Incident InformationWhen you use Safety Kuvrr to transmit any information pertaining to an incident (including video, audio, text and other data), ArmourGrid will collect such information.

C. Geo-Location Information: Unless you disable the geo-location functionality of the application or your mobile device, Safety Kuvrr will track your location (when ArmourGrid is activated and the GPS service on the phone is enabled) and associate/store such location with any messages, data or incidents that you transmit through Safety Kuvrr.

D. Passive Information Collection: As you navigate through Safety Kuvrr, certain information can be passively collected (that is, gathered without you actively providing the information) using various technologies, such as navigational data collection.  For example, when using Safety Kuvrr, we and/or our service providers may track Internet Protocol addresses, use session and persistent cookies, use session IDs and assign Internet tags.  Our system may also automatically gather information about the application areas you visit on Safety Kuvrr and collect operational information about the technology you use, such as your browser, operating systems, IP address, system and application software, peripherals, Internet service providers and the domain name of the web site from which you linked to Safety Kuvrr.   In addition, when you view or use Safety Kuvrr, we may store some information on your computer or mobile device.  This information will be in the form of a cookie, flash cookie or similar file and will help us in many ways.  We reserve the right to use, and to permit our service providers to use, such cookies, flash cookies and web beacons, as well as other comparable or future technologies, to collect information regarding usage of Safety Kuvrr or our applications (including use of our applications on third party sites).  We passively collect information to understand what areas of Safety Kuvrr are most popular, which areas may require improvement and what technologies are being used by our visitors.  This information helps us to update and improve Safety Kuvrr.  We also use this information for security purposes, to detect and to block security breaches and to provide you with a safe Service usage environment.

2. USAGE OF SERVICE BY MINORS

Safety Kuvrr is not directed to individuals under the age of 13, and we request that these individuals do not use Safety Kuvrr.

3. HOW THE COMPANY MAY USE AND DISCLOSE INFORMATION OBTAINED THROUGH SAFETY KUVRR

A. Designated Recipients: During the registration process and through use of account management tools, you will be asked to identify one or more recipients, Organizations, and/or Agencies of any incident reports you elect to initiate through Safety Kuvrr.  Accordingly, when you utilize Safety Kuvrr to initiate an incident, you acknowledge and agree that all content in the incident report will be made available to and accessible by ArmourGrid and the foregoing recipients and you have no expectation of privacy in connection therewith.  ArmourGrid is not responsible for whether or how such third parties utilize the content and data you send to them.

B. Emergency Responders: From time-to-time, Agencies may subscribe to Safety Kuvrr.  When you are within the designated geographic zone of such emergency responders, such third parties will receive any incidents you report through Safety Kuvrr as well as any applicable Personal Information you have supplied.  Accordingly, when you utilize Safety Kuvrr to initiate an incident, you acknowledge and agree that all content in the incident report and related profile information will be made available to and accessible by ArmourGrid and the applicable emergency responders, and you have no expectation of privacy in connection therewith.  ArmourGrid is not responsible for whether or how such third parties utilize the content and data you send to them.

C. ArmourGrid Use: Your contact information (e.g., e-mail addresses, phone number) will only be used for the purposes for which you supplied it to us (e.g., responding to your incidents, inquiries comments or requests for information, sending requested newsletters, etc.).  Your billing information (credit card number, billing address) will only be used to process transactions between you and ArmourGrid.

Except as otherwise stated, we may use information collected internally to operate Safety Kuvrr, to improve Safety Kuvrr, to customize Safety Kuvrr to your preferences, to communicate information to you, for research purposes, for data analysis, audits, fraud monitoring and prevention, for developing new products, conducting surveys, determining the effectiveness of our communications and marketing, enhancing, improving or modifying Safety Kuvrr, for identifying usage trends, and operating and expanding our business activitiesand and any other purpose specified in this policy.  In addition, we may make full use of all information acquired through Safety Kuvrr that is not in personally identifiable form.

D. Other ArmourGrid Disclosures: In addition to the disclosure of your information to recipients and responders as described in clauses 2A, 2B, and 2C above, we may disclose any of the information you provide:

(i) to contractors we use to support our business (such as hosting providers, technical support, web analytics and financial institutions), in which case we will require such third parties to agree to use it for the same purposes;

(ii) in the event of a sale, merger, liquidation, dissolution, reorganization, assignment or other transfer of ArmourGrid or the business of Safety Kuvrr to which the information relates, in which case we will require any such buyer to agree to treat it in accordance with this Privacy Policy and use it for the same purposes;

(iii) As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations; (f) to protect our rights, privacy, safety, or property, and/or those of you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

(iv) in situations involving threats to the physical safety of any person.

(v) ArmourGrid does not otherwise distribute to third parties your personally identifiable information.  You agree, however, that ArmourGrid shall have no liability for disclosure of information obtained due to errors in transmission or the unauthorized intervention of third parties.

E. Usage Statistics, Aggregated and De-identified Information: ArmourGrid may de-identify and aggregate your personal information (including, without limitation, usage statistics and geo-location information) with information from other users of Safety Kuvrr.  ArmourGrid may use or disclose such aggregated information for purposes of operating, modifying, improving, promoting or otherwise commercializing Safety Kuvrr or the aggregate data, but in no event shall such aggregated information include any personally identifying information.

4. CHOICES YOU HAVE ABOUT HOW THE COMPANY USES YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us.  You may modify the personal information on your account at any time.  However, such modifications or deletions will only affect reports after the date of such modifications; any data associated with prior incident reports will remain unmodified as previously provided to your recipients and stored in our servers.  You also have control over which recipients will receive your incident reports and what profile data you elect to include and make accessible.

A. Tracking Technologies: You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether or not to allow Safety Kuvrr to collect information through other tracking technologies. If you disable or refuse cookies or block the use of other tracking technologies, some parts of Safety Kuvrr may then be inaccessible or not function properly.

B. Location Information: You can choose whether or not to allow Safety Kuvrr to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of Safety Kuvrr may then be inaccessible or not function properly which will degrade our ability to provide accurate and timely service and/or incident reports.

C. Audio and Visual Information: You can choose whether or not to allow Safety Kuvrr to collect and use real-time audio and/or visual information from your device during an incident initiated by you or during the usage of Safety Kuvrr, through the device's privacy settings. If you block the transmission and/or use of audio and/or visual information, some parts of Safety Kuvrr may then be inaccessible or not function properly which will degrade our ability to provide accurate and timely service and/or incident reports.

5. HOW THE COMPANY PROTECTS YOUR INFORMATION

We work hard to protect your personal information.  We use both technical and procedural methods to maintain the integrity and security of our databases, including the use of encryption and limited access to data.  We seek to use commercially reasonable measures to protect your personal information within our organization, but no data transmissions through the Internet or via mobile devices, or even the physical transfer of information, can be guaranteed to be completely secure or error free. We cannot fully eliminate all security risks associated with your personal information. We do not ensure or warrant the security of any data or information you transmit to us, and you do so at your own risk. PLEASE NOTE:  The safety and security of your information also depends on you.  Never share your password with anyone else, notify us promptly if you believe your password security has been breached, and remember to log off of Safety Kuvrr before you leave your computer or mobile device.

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

6. YOUR CALIFORNIA PRIVACY RIGHTS

In addition to the rights as explained in this Privacy Policy, under California’s “Shine the Light” law, California residents who provide personal information (as defined in the statute) are entitled to request once a calendar year a notice about the personal information we shared, if any, with other businesses for marketing uses. If applicable, this notice would include the categories of personal information and the names and addresses of those businesses with which we shared such personal information for the immediately prior calendar year (for example, requests made in 2017 will receive information about 2016).
